Nassau County Clerk Records

The Nassau County Clerk is at 240 Old Country Road in Mineola. The office maintains criminal case records for Supreme Court and County Court. Walk-in visitors can inspect the criminal case index during business hours. Viewing is free. Copies cost about 65 cents per page. Certified copies are $8 per document.

A name search runs $5 for two years. Each additional two-year span costs $1.25. Mail requests are accepted with a check payable to the Nassau County Clerk. Include the full name and date of birth and the time period you want searched. Nassau County handles a very high volume of filings, so the criminal case index is extensive. The clerk also processes land records, notary filings, and other public documents.

Nassau County has its own unique court structure. Unlike most upstate counties, Nassau has a District Court that handles misdemeanors, small claims, and other local matters instead of town and village courts. This means District Court records are a separate source from Supreme and County Court records held by the clerk. Both should be checked for a thorough background check.

Background Check Through Nassau County Courts

Nassau County is in the 10th Judicial District. The court system includes Supreme Court and County Court in Mineola plus the Nassau County District Court. District Court operates out of multiple locations across the county, including Hempstead and other communities. It handles misdemeanors, violations, and traffic cases. Felonies start at the District Court for arraignment and then get transferred to County Court.

Record sealing rules apply the same way as the rest of the state. CPL 160.50 automatically seals dismissed and acquitted cases. CPL 160.55 covers certain violation convictions. CPL 160.59 lets a person petition for sealing of up to two older convictions. The Clean Slate Act will add automatic sealing. Eligible misdemeanors seal three years after sentence completion. Felonies seal after eight years. Convictions for sex offenses under SORA and non-drug Class A felonies are never eligible.

The Division of Criminal Justice Services maintains the official criminal history database for New York under Executive Law Article 35. A fingerprint-based check through DCJS covers arrests, convictions, and sentences from all agencies statewide, including the Nassau County Police Department and local courts. This is the most accurate background check method available.

A personal record review costs about $62 to $65 and requires fingerprints. Results come as a rap sheet or "no record." Suppressed reports leave out sealed cases. Unsuppressed reports show everything, including records sealed under CPL 160.50, CPL 160.55, CPL 160.58, and CPL 160.59. You cannot request someone else's record without legal authority. Nassau County Law Enforcement Records

The Nassau County Police Department is the primary law enforcement agency for the county. NCPD serves most unincorporated areas and many villages that contract for police services. The department maintains arrest records and incident reports. Records requests go through FOIL. Under Public Officers Law Sections 84 through 90, any person can request records. Agencies have five business days to respond.

The Nassau County Sheriff handles court security, civil process, and runs the county correctional center. The sheriff maintains jail booking records and inmate information. Some villages in Nassau County have their own police departments with separate records. NCPD processes a large number of FOIL requests. Response times can be longer than in smaller departments. Copy fees are 25 cents per page. In-person inspection at the clerk's office is free. DCJS criminal history records are not available through FOIL.

Record Sealing and Clean Slate Act in Nassau County

Nassau County courts process a high volume of sealing requests. The Clean Slate Act took effect November 16, 2024 and will eventually bring automatic sealing for eligible convictions. OCA has up to three years to build the automated system. Until it is running, DCJS reports may still show convictions that will qualify for sealing.

People with older convictions can still petition under CPL 160.59 for sealing of up to two eligible convictions. Certificates of Relief from Disabilities and Certificates of Good Conduct remain available for those whose records do not qualify for sealing. These certificates create a presumption of rehabilitation but do not seal the record itself. Judiciary Law Section 255 gives courts authority over management of their own records. Convictions for sex offenses under SORA are never eligible for any form of sealing.

Sex Offender Registry in Nassau County

The Sex Offender Registry from DCJS covers Nassau County under SORA. Level 2 and Level 3 offenders appear in the public online directory. For Level 1 information, call 800-262-3257 with the name and one identifier. Public data includes addresses, conviction details, and photos. Level 3 offenders verify their address every 90 days. Sexual predators register for life. Others register for 20 years. Sign up through NY-ALERT for address change notifications.

Corrections and Incarceration Records

The Nassau County Correctional Center is run by the sheriff's office. It holds pretrial detainees and inmates serving sentences of one year or less. The Department of Corrections and Community Supervision handles state prison sentences. The DOCCS inmate lookup at nysdoccslookup.doccs.ny.gov covers all 42 state prisons.
