Clean Slate Act and Record Sealing

New York's Clean Slate Act became effective November 16, 2024. Misdemeanor convictions become eligible for automatic sealing three years after the sentence is complete. Felony convictions take eight years. The person must have no new convictions or pending charges during the waiting period. Sex offenses under SORA and non-drug Class A felonies are never eligible for sealing. OCA has up to three years to build the required system.

Until the automated system is in place, background check results from DCJS will still show convictions that may eventually be sealed. Law enforcement and courts retain full access regardless of sealing. For convictions that do not qualify, petitioning under CPL 160.59 remains an option. Certificates of Relief from Disabilities and Certificates of Good Conduct create a presumption of rehabilitation. No filing fee is needed for either certificate. Apply in the court where the last conviction happened.

Driving Records and Additional Databases

A DMV driving abstract is often part of a complete background check. Standard abstracts cost $7 through MyDMV. DWI convictions stay on the record 15 years. DWAI remains for 10 years. Vehicular homicide is permanent. Request online, by mail with Form MV-15, or in person at a DMV office. A certified copy by mail is $10.

A lifetime driving abstract includes all information the DMV currently holds about a driver, going beyond the standard retention window. Most traffic convictions appear until the end of the year they occurred plus three more years. Suspensions and revocations remain on the abstract for four years from the date they ended. A chemical test refusal shows for five years from the date of suspension. To request online, log into your MyDMV account. You need your license number, document number, and the last four digits of your Social Security number. Mail requests use Form MV-15 sent to MV-15 Processing, NYS DMV, 6 Empire State Plaza, Albany, NY 12228. Include a check or money order for $10 for a certified copy. In-person requests require Form MV-15C and a photo ID at any local DMV office.
