Queens County Clerk Records Search

The Queens County Clerk's Office Records Search Department is at 88-11 Sutphin Blvd., Jamaica, NY 11435, Room 106. The phone number is (718) 298-0609. All searches must be in writing. No verbal requests are accepted. The fee for a search and certificate is $10.00. That fee covers a two-year search period. If you need more years searched, it costs $5.00 for each extra two-year block.

Cases are filed by the date they began, not when they ended. Keep that in mind when you set your search dates. Case index numbers from before 1992 are stored on microfiche. You can view those in person or ask staff to pull them for you.

Certified copies of Supreme Court documents cost $8.00 per certification. Business and corporate filing certifications are $10.00 each. An exemplified copy runs $25.00 plus the certification fee. Plan for 48 to 72 hours of processing time for exemplified copies. The copy fee is 65 cents per page, with a minimum charge of $1.50.

All fees must be paid by U.S. postal money order, certified check, or NYS attorney's check. Personal checks are not accepted. You need separate money orders for each two-year search period and for any certification or exemplification fees. This is a strict rule at the Queens County Clerk's office.

Queens County Criminal Court Background Check

The court handles misdemeanor cases, violations, and felony arraignments. Felony cases move to Supreme Court after arraignment.

You can visit the court and review case indices and dockets at no cost. Public Officers Law Section 87(1)(b)(iii) lets you inspect records without charge. You may look at court files under staff supervision. You can take notes from the records. If you want copies, the fee is $0.25 per page for standard documents.

The WebCriminal portal gives basic case data for criminal matters in Queens County courts at no cost. It shows defendant names, charges filed, next court dates, and case status. Full court documents are not available online. For those, contact the clerk's office in person.

The Division of Criminal Justice Services handles fingerprint-based criminal history checks. The cost is about $62 to $65. DCJS records are not public under FOIL. You must submit your own fingerprints. You cannot request another person's DCJS record without specific legal authority under Executive Law Article 35. DCJS provides two types of responses. A suppressed response hides sealed records. An unsuppressed response shows everything, including cases sealed under CPL 160.50, CPL 160.55, CPL 160.58, CPL 160.59, and CPL 720.35.

Public Records Access in Queens County

New York's Freedom of Information Law applies to Queens County government offices. Under Public Officers Law Sections 84 through 90, anyone can request records from a government agency. You do not need to live in New York. Agencies must respond within five business days. They can grant access, deny with an explanation, or give a date when records will be ready. The standard copy fee is 25 cents per page.

FOIL does not cover DCJS criminal history records. Those need the fingerprint process. But court records, incident reports, and most other agency records in Queens do fall under FOIL. If a request is denied, you have 30 days to appeal. If that appeal fails, the next step is an Article 78 proceeding in Supreme Court.

Queens County also has a local District Attorney's office that handles prosecutions. Records requests to the DA go through FOIL as well. Active investigation records may be held back if release would interfere with an ongoing case.

Queens County Background Check and the Clean Slate Act

New York's Clean Slate Act took effect on November 16, 2024. It calls for automatic sealing of certain convictions after waiting periods pass. Misdemeanor convictions become eligible three years after the sentence is done. Felony convictions qualify after eight years. There must be no new convictions or pending charges during the wait.

The Office of Court Administration has up to three years to build the automated system. Until that is ready, a Queens County background check through DCJS may still show convictions that will later be sealed. Law enforcement and courts keep full access to all records. Convictions for sex offenses under SORA and non-drug Class A felonies like murder are never eligible for sealing.

People whose convictions do not qualify for Clean Slate can still file a petition under CPL 160.59. Certificates of Relief from Disabilities and Certificates of Good Conduct also remain available. These do not seal records but create a presumption of rehabilitation.
