Washington County background check records are maintained by the County Clerk and local courts in Fort Edward, New York. Washington County Clerk Records

Fingerprint-Based Background Check

The Division of Criminal Justice Services is the sole source for fingerprint-based criminal history records in New York State. Executive Law Article 35 gives DCJS this authority. Fingerprint submission is required. The fee is between $62 and $65.

DCJS records show arrests, indictments, convictions, and sentences from agencies across New York. A suppressed response omits sealed records. An unsuppressed response includes everything, such as cases sealed under CPL 160.50, CPL 160.55, CPL 160.58, and CPL 160.59. The type of response depends on the legal basis of the request.

The Clean Slate Act took effect November 16, 2024. Eligible misdemeanors can be sealed three years after the sentence is complete. Felonies need eight years. The person must have no new convictions or pending charges during that time.

OCA has three years to build the sealing system. Until it is live, Washington County background check results may still show convictions that will eventually be sealed. Sex offenses under SORA and non-drug Class A felonies are never eligible. People who do not qualify can petition under CPL 160.59. Certificates of Relief from Disabilities and Certificates of Good Conduct remain available through Judiciary Law Section 255.

FOIL Public Records Access
