Background Check Search Options
The OCA Criminal History Record Search is a statewide name-based search for $95. It covers all 62 New York counties, including Fulton. Results include open cases, pending charges, and convictions from county, supreme, city, town, and village courts. An exact name and date of birth match is required. Each alias is a separate $95 search. Sealed records are not returned. Online searches with no results come back immediately. If records are found, OCA staff review and email results the next business day.
The Division of Criminal Justice Services provides fingerprint-based criminal history. Under Executive Law Article 35, DCJS is the sole official repository. You submit fingerprints and pay about $62 to $65. The response is either a rap sheet or a "no record" letter. A suppressed response leaves out records sealed under CPL 160.50, CPL 160.55, CPL 160.58, and CPL 160.59. An unsuppressed response includes everything. You can only request your own record unless a specific law authorizes you to request someone else's.
Public Records Requests Through FOIL
The Freedom of Information Law lets anyone request records from Fulton County agencies. Public Officers Law Sections 84 through 90 govern this process. You do not need to be a resident. FOIL covers incident reports, sheriff's office records, county department files, and other government documents. The copy fee is 25 cents per page. Agencies must respond within five business days. DCJS records are exempt from FOIL. Court records and most other county government files are not.

Clean Slate Act and Fulton County Records
New York's Clean Slate Act took effect November 16, 2024. The law calls for automatic sealing of eligible convictions. Misdemeanors qualify three years after the sentence ends. Felonies qualify after eight years. The person must have no new convictions or pending charges during that time. Sex offenses under SORA and non-drug Class A felonies cannot be sealed under this law.
The Office of Court Administration has three years to build the automated sealing system. Until it is running, Fulton County background check results may still include eligible convictions. People whose records do not qualify for Clean Slate can petition for sealing under CPL 160.59. Certificates of Relief from Disabilities under Judiciary Law Section 255 remain available. These certificates create a legal presumption of rehabilitation and can help remove bars to certain jobs and professional licenses, though they do not erase the conviction from the record.
