Erie County Clerk and Court Records

The Erie County Clerk's office in downtown Buffalo serves as custodian of Supreme and County Court records. This is one of the busiest clerk's offices in the state, handling a high volume of criminal and civil filings each year. The office stores criminal case files, judgments, liens, and land records. Walk-in searches are available during regular business hours. You can inspect court files at no charge. Copy fees are about $0.65 per page, and certified copies cost more.

Erie County sits in the 8th Judicial District. Felony cases are heard in County Court or Supreme Court at the courthouse in Buffalo. The Buffalo City Court handles a large caseload of misdemeanors, violations, and felony arraignments on its own. Town and village courts across the rest of the county process local cases. A name search through the clerk's office costs roughly $5 per two-year period. Certified copies of court documents run $5 to $10 per certification. For a formal Certificate of Disposition, you need to go to the court that originally handled the case.

Erie County is one of the few jurisdictions in New York where the WebCriminal system provides online access to criminal court case information. You can search by defendant name or case number. The system shows charges, next court dates, and case status. It does not include sealed cases or full court documents. Free public access is available. The OCA Criminal History Record Search is the main statewide name-based option. It costs $95 per name and covers court records from all 62 New York counties. Erie County is fully included. Results show open cases, pending matters, and convictions from county, supreme, city, town, and village courts. Each alias or date of birth variation requires a separate $95 fee. Sealed records do not show up. Online submissions that return no results come back in real time. If records are found, staff review and email results the next business day.

For the most accurate results, the Division of Criminal Justice Services offers fingerprint-based criminal history records. Under Executive Law Article 35, DCJS is the state's sole official repository. You submit fingerprints and receive either a rap sheet or a "no record" response. The fee is about $62 to $65. Suppressed responses leave out records sealed under CPL 160.50, CPL 160.55, CPL 160.58, and CPL 160.59. Unsuppressed responses include sealed records. You need legal authority to request someone else's record through DCJS.

At the county level, the Erie County Sheriff's Office also maintains arrest records and incident reports. These can be obtained through FOIL requests. The sheriff's office provides fingerprinting services as well. Between the clerk's office, WebCriminal, the sheriff's office, and the state systems, Erie County offers more background check options than most New York counties.

Erie County Public Records and FOIL

Under the Freedom of Information Law, anyone can request records from Erie County government agencies. Public Officers Law Sections 84 through 90 cover this right. You do not need to be an Erie County resident. The law applies to police reports, sheriff's office records, county department files, and any other government documents. The copy fee is 25 cents per page for standard-sized documents. Agencies must respond within five business days.

DCJS records are not available through FOIL. Court records, incident reports, and most other Erie County agency files are covered. Denials can be appealed within 30 days. If the appeal fails, an Article 78 proceeding in Supreme Court is the next step. Erie County has a records access officer in each major department to handle FOIL requests. Given the size of the county, FOIL is a common tool for getting records from the many agencies that operate here.

Erie County Sex Offender Registry

The Sex Offender Registry run by DCJS includes all registered offenders in Erie County. Level 2 and Level 3 offenders are in the online directory, searchable by name, county, or zip code. Level 1 offenders are not listed online. Call 800-262-3257 with the person's name and one identifier to check on Level 1 registrants. Erie County, because of its large population, has a higher number of registered offenders than many other counties in the state. Level 3 offenders must verify their address every 90 days. Registration lasts 20 years for most offenders and life for sexual predators and predicate sex offenders. Use NY-ALERT for relocation notifications.

Corrections and Incarceration Records

The Department of Corrections and Community Supervision manages the state prison system. Anyone sentenced from Erie County to state prison can be found through the DOCCS inmate lookup at nysdoccslookup.doccs.ny.gov. Search by name, DIN, or NYSID number. Results show current facility, sentence information, parole dates, and conviction details. Records date back to the 1970s.

For county-level incarceration, the Erie County Sheriff's Office runs the county holding center and correctional facility. The Erie County Holding Center in downtown Buffalo houses pre-trial detainees. The Erie County Correctional Facility in Alden holds sentenced inmates. Booking records and inmate information can be obtained through FOIL requests to the sheriff's office. The VINE notification system is available for victim alerts about custody status changes.

Clean Slate Act Impact on Erie County Background Checks

The Clean Slate Act took effect November 16, 2024. It provides for automatic sealing of eligible convictions. Misdemeanor convictions become eligible three years after the sentence ends. Felonies require eight years. No new convictions or pending charges can be on the person's record during the wait. Sex offenses under SORA and non-drug Class A felonies are never eligible for automatic sealing.

OCA has up to three years to build the automated system. Until then, Erie County background check results from DCJS may still include convictions that will eventually be sealed. Given Erie County's large population and high volume of criminal cases, the Clean Slate Act will affect a significant number of records here. People who do not qualify for automatic sealing can still petition under CPL 160.59. Certificates of Relief from Disabilities under Judiciary Law Section 255 remain available as well.
