Clean Slate Act and Rochester Background Checks

New York's Clean Slate Act took effect November 16, 2024. Eligible misdemeanor convictions seal automatically three years after the sentence ends. Felony convictions take eight years. The person must have no new convictions or pending charges during the waiting period. Convictions for sex offenses under SORA and non-drug Class A felonies are excluded. OCA has up to three years to implement the automated sealing system.

Until the system is built, background check results from DCJS may still show convictions that will eventually be sealed. Law enforcement and courts keep full access. For convictions that do not qualify for automatic sealing, petitioning under CPL 160.59 is still an option. Certificates of Relief from Disabilities cover one felony or any number of misdemeanors. Certificates of Good Conduct apply to two or more felonies. No filing fee is needed for either. They do not seal the record but create a presumption of rehabilitation.

Driving Records and Additional Databases

A driving record abstract from the DMV often rounds out a full background check. Standard abstracts cost $7 through MyDMV. A lifetime abstract includes the full available history. DWI convictions stay on record for 15 years. DWAI remains for 10 years. Vehicular homicide appears permanently. A certified copy by mail costs $10 via Form MV-15. You can also request in person at a DMV office with Form MV-15C and photo ID.

Most traffic convictions appear on the abstract until the end of the year they happened plus three more years. Suspensions and revocations stay for four years after they end. A chemical test refusal shows for five years from the suspension date. Request your abstract online using your license number, document number, and last four digits of your Social Security number. Mail requests go to MV-15 Processing, NYS DMV, 6 Empire State Plaza, Albany, NY 12228. Include a copy of your ID and a check or money order for the fee amount.
